Mutation Entry Doesn't Confer Property Title: SC

Supreme Court in its recent ruling has once again made it clear that Mutation does not amount to transfer of title.

The Bruhat Bengaluru Mahanagara Palike (BBMP), Karnataka filed a plea in The Supreme Court challenging the Karnataka High Court judgment which directed to mutate a property of which Title Suit was pending. The concern was that when the title suit is pending how come mutation can be directed.
The said plea was disposed of by a bench comprising of Justices DY Chandrachud, Justice Indira Banerjee, and Justice Sanjiv Khanna. The court observed that mutation does not amount to any transfer of title and the same has to be established independently by following due course of law.
A similar judgment was pronounced by Supreme Court in Narasamma & Ors. Vs. State of Karnataka & Ors. (2009) 5 SCC 591, in which the Apex Court clearly stated that the entries in the revenue record cannot create any title of the land.
